Speaker Bio:  Sarah Decker is a Community Outreach and Resource Planning Specialist for the Albany NY District Office of the US Department of Labor’s Wage and Hour Division. She was initially hired by the Department of Labor as a Wage and Hour Assistant in 2012, and shortly thereafter became an Investigator, a position she held for 8 years. As an Investigator, she enforced federal labor laws, including the Fair Labor Standards Act, the Service Contract Act, the Davis-Bacon and Related Acts, the Family and Medical Leave Act, the Migrant and Seasonal Agricultural Worker Protection Act, and the employer’s requirements under the temporary work visa programs: H-2A, H-2B, and H-1B.  In 2020, Sarah accepted a position as the Albany District’s Community Outreach and Resource Planning Specialist (CORPS).  As a CORPS, Sarah educates employees and employers about the federal labor law requirements.  She is originally from Richmond, VA and came to federal employment by way of the Peace Corps, serving two years as an English teacher in Kazakhstan.

 

Background, Professional and industry experience Ms. Decker has a Bachelor’s Degree from Christopher Newport University in Newport News, VA. She was hired by the US Department of Labor, Wage and Hour Division in 2012 and has worked for the Department for twelve years. Eight of those years she was an Investigator, conducting investigations of employers and enforcing federal labor laws, including numerous investigations under the Fair Labor Standards Act, the Family and Medical Leave Act, and the H-2A and H-2B visa programs. Ms. Decker became a Community Outreach and Resource Planning Specialist for the Albany NY District Office in December 2020. As an Outreach Specialist, Ms. Decker conducts educational outreach to educate employees and employers about the federal labor law requirements.

 

Summary of Presentation The Fair Labor Standards Act (FLSA) requires employers to provide reasonable break time for an employee to express breast milk for their nursing child for one year after the child's birth each time such employee the has need to express the milk. Employees are entitled to a place to pump at work, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public.

 

On December 29, 2022, President Biden signed the Consolidated Appropriations Act, 2023 into law. The law includes the PUMP for Nursing Mothers Act (“PUMP Act”), which extends to more nursing employees the rights to receive break time to pump and a private place to pump at work. The new protections also expand remedies available to these workers if their employers do not comply with the law.

 

Sarah Decker, Outreach Specialist for the US DOL Wage & Hour Division - which enforces the PUMP Act and the FLSA - will discuss the requirements of the PUMP Act and answer attendee questions.

 

Speaker Bio: Elizabeth Adams Marcus is a Mediator at the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency dedicated to eradicating employment discrimination in the workplace.  Elizabeth mediates hundreds of discrimination cases each year, totaling thousands over the span of her career.  Complaints raise issues such as harassment, hostile work environment, disparate treatment, reasonable accommodation, and retaliation.  A large proportion of the employees and some of the employers in her cases are pro se.  Elizabeth mediates both public and private sector cases.  She has expert knowledge of the EEOC complaint process and a strong working knowledge of EEOC federal sector complaint process. 

 

Background, Professional and Industry Experience Since completing her formal education at the University of Connecticut and New England Law | Boston, Elizabeth has worked exclusively in the field of employment discrimination law, first with the Massachusetts Commission Against Discrimination (MCAD) and then with the EEOC.  She has completed formal mediation training with New York University School of Law, Cornell University’s School of Industrial and Labor Relations, and Mediation Works, Incorporated.  Elizabeth is an engaged and enthusiastic mentor both as a mediation clinic placement and as an adjunct professor or mediation.  She is a regular presenter in discrimination and mediation forums including EEOC Technical Assistance Programs, the Harvard Program on Negotiation, the Massachusetts Bar Association, and the Boston Law Collaborative.  Elizabeth is also a member of the Dispute Resolution Section Council of the Massachusetts Bar.

 

Summary of Presentation Elizabeth will provide an overview of employee’s rights and employer’s obligations under the newly-enacted Pregnant Worker’s Fairness Act (PWFA).
